Tuition@VLC is a licensed tuition agency that provides parents/students/tutees with private home tutors. We are a registered company with Suruhanjaya Syarikat Malaysia (SSM)(PG0184750-M) under Victory Learning Centre, herein referred to as “VLC” or “we” have created this privacy statement (“Statement”) in order to demonstrate our firm commitment to the privacy of the details that you provide to us when using this website, as the data controller for the purposes of the Personal Data Protection Act 2010.

In this Statement, references to “you” and “your” are references to the User of i.e. www.victory-learning.com (the “Site”) regardless of whether you are a Client or a Tutor or other user. It applies to information we collect about Users of our Site and amongst other things, this Statement describes what personally identifiable information “Personal Information” we collect from you, how and when it is used, how we protect it and who has access to it. This Statement incorporates our Cookie Policy.

1.0 INTRODUCTION

In compliance with the Personal Data Protection Act 2010 (“the Act”) and its regulations, this notice is issued to all our valued clients/tutors and/or prospective clients/tutors. This statement will inform you of your rights with regards to your personal data that has been and/ or will be, collected and processed by us.

2.0 COLLECTION OF PERSONAL DATA

We have collected and will collect your personal data to be processed by us and/ or on your behalf in the course of your present or future dealings with VLC. Your personal data enables us to achieve  the “Purpose” herein that is in connection with our business.

3.0 PURPOSES FOR COLLECTION OF PERSONAL DATA

VLC processes personal data as a necessary part of entering into and performing our contract with you, which is governed by our Terms and Conditions. As part of the process of using the Site and the Services, we require you to give us certain Personal Information which we need to provide our Service. Without this information we may not be able to fulfil our contract with you. This information includes:

• Account information: to enable us to create an account for you on the Site. Depending on whether you register as a parent, student, school pupil, or tutor, this information can include your name, email, telephone number, postal address, and date of birth.
• Tutor application details: so we can process your application to become a tutor. These details include your educational background and qualifications, your tutoring subjects, your profile picture and your resume, the prices you charge, your availability and your gender.
• Communication history: to enable communication with other users of the website and with the VLC team, we store details about your communication history including user messages, requests you have made, and your interactions with the VLC team 
• Booking history: to facilitate tutorials including information on booking requests, status of bookings, booking subjects and levels, results of your set-up tests whilst using the lesson space and recordings of your bookings (bookings include tutor interviews, free meetings, lessons and written sessions.)
• Promotions you redeemed: we record details of referral codes shared, redeemed and other promotions you interact with to be able to apply rewards to your account.
• Identity verification information: when you apply as a tutor we ask for verification based on your ID and qualification that you have registered with. 
• Financial information:
  • We may require you to provide us with Financial Information to authorise or process payment and bill you or pay you for the Services. These details include for tutors: your nominated bank account, your invoices and your payment history, and for customers your payment history and payment card details.

    When you book Tutoring Services via the Site (if you are a Client) or when you receive payment for delivering Tutoring Services via the Site (if you are a Tutor), we will pass your Financial or Personal Information to those third parties necessary to process your transactions with us, such as credit card companies and banks.

  • The legal basis under PDPA by which we are permitted to process this information in this way is that it is necessary for the performance of a contract to which you are a party, or to take steps prior to entering into a contract with you or where we need to comply with a legal obligation. This includes exchanging information with other companies and organisations for fraud protection and credit risk reduction. Except as provided above, we will not share Financial Information with third parties without your prior consent.

4.0 SOURCES OF PERSONAL DATA

We collect some information from all users of the VLC site regardless of whether you are registered with us as a customer or tutor, to fulfil our contract with users and to enable our legitimate interests in providing the VLC site and services.

• Automatically tracked information includes: Cookie information, your IP address, details of the device you use to access the Site, the pages you visit and the actions taken, the times and dates of actions you take on our website, your interactions with our email, text and in-app messages, the source of your visit and/or previous webpage before visiting our Site, and your page response times.
• Tutor capacity information: If you have a profile as a tutor on the Site we collect information on your on-site behavior, capacity and interactions with other users to help show you the most relevant requests and show customers the most relevant tutors.

5.0 DISCLOSURE OF PERSONAL DATA

 We may disclose client’s/tutor’s personal data to other subsidiaries within our group. These subsidiaries will treat client’s personal data as confidential , in accordance with this Privacy Policy and with all applicable Data Protection legislation and will process such personal data only for the Purposes and within the terms set out herein. We are responsible for the personal data under our control. We take every measure to provide a comparable level of protection for  personal data and is committed to complying with the Personal Data Protection Act 2010 , in particular, its policies as well as corresponding guidelines and orders.

6.0 SECURITY OF PERSONAL DATA

VLC uses strict procedures and security features to prevent unauthorized access wherever possible. Personal data provided to VLC via our website or via any Applications , online credit card transactions are protected during transit using encryption such as Transport Layer Security (TLS). When personal data is stored by VLC, we use computer systems with limited access housed in facilities using physical security measures. Data stored in cloud services is in encrypted form including when we utilize third-party storage. The level of security of personal data which kept in a non-electronic environment are also treated with strict procedures and means.

7.0 USE OF COOKIES

The cookies used by the Website are solely associated to anonymous users and their computers and do not provide personal data on users. Some cookies are used by third parties to provide VLC with data on the effectiveness of its engagements and promotions. The cookies used by the Website not in any way collect personal data that could be used to identify a specific user. In addition, cookies are of a temporary nature, used solely to improve the efficiency of the last transmission . Users may configure their browser to notify them of the reception of cookies and to prevent their installation on their computer.

8.0 TRANSFER OF PERSONAL DATA

We are very serious about providing a comparable level of protection for personal data should the information be processed or used outside Malaysia by our vendors or experts .

9.0 DATA SUBJECT’S OBLIGATIONS

It is necessary for VLC to collect and to retain clients’ personal data. Therefore, it is also obligatory for clients to supply personal data to us in the most accurate manner. If clients do not provide us with personal data, VLC are unable to , process personal data on clients’ behalf, for the Purpose stated in clause 4 herein, or effectively render our services to clients , and all relationships created or to be created between us shall then be terminated and ceased to be in effect immediately.

10.0 CHANGES TO PRIVACY POLICY
